Terms of Service
Who We Are
Digiesim is a trading name of Acom Solutions Limited, registered in England and Wales (Company Registration Number: 07285389).
What This Agreement Covers
We provide eSIM profiles and mobile data services, collectively referred to as "Services." You accepted these terms when you purchased our Services, which outlines both our responsibilities and yours. Some mobile network operators we partner with may also have specific terms that apply to certain Services; you can find these on their websites.
Your Responsibilities
By using our Services, you agree to:
- Comply with all laws.
- Avoid actions that are abusive, illegal, or fraudulent, and do not harm the network.
- Use our Services for personal purposes only.
- Refrain from reselling our Services or using them with any mobile gateways.
- Ensure your device is eSIM compatible, unlocked, and meets UK technical standards.
Using Your Services
Your Services will only activate once you:
- Purchase a Plan.
- Install the eSIM and connect it to a network in the region for which you bought a Plan.
Please note that our Services do not allow you to make voice calls or access emergency services. Even if you have a number linked to your data Plan, it can be modified or withdrawn without notice.
Your Plan
- You can activate and pay for Plans via the Digiesim digital channels. Each Plan has a validity period and specific data allowance.
- To keep your service running without interruption, be sure to renew your Plan before it expires.
- We offer an auto-renewal option for your convenience. If you opt for this, we'll charge you automatically at the end of each Plan period. This charge may change if you switch Plans or if we adjust our prices, which we will notify you about. You can cancel or manage your auto-renewal preferences through the App or by contacting customer care. Please ensure you make any changes at least 24 hours before your current plan ends.
- Data usage is rounded up to the next kilobyte after each session, and all purchased data expires if your Plan is terminated for any reason.
- Your data usage is monitored by our network suppliers. Once your data is used up, you won't be able to send or receive more data until you top up your Plan. Activities such as streaming, using a mobile hotspot, or downloading large files will consume data more quickly.
- You are responsible for how the Services are used, even if someone else uses them.
- Topping up or purchasing a new Plan will reset your usage limits and speeds.
- Some uses, like tethering, might be allowed under your Plan but are subject to our Acceptable Use Policy.
Network Access
To access our network, you'll need a compatible device with eSIM capabilities in a coverage area. Actual availability and speeds may vary, and during busy times, speeds could be reduced. Certain data-heavy activities might be limited in areas with poor coverage.
Paying for Your Plan
- All prices are in USD VAT.
- We do not offer refunds for devices incompatible with eSIMs or for unused data after a Plan expires.
- Our pricing and Plan structures may be updated regularly.
Your Privacy and Data
For details on how we handle your personal data, please refer to our Privacy Policy.
Limits on Our Liability
We won’t be liable for:
- Issues arising from your eSIM or equipment due to neglect or tampering (unless caused by us).
- Any content accessed or sent using our Services, or for third-party charges incurred.
- Delays or failures in providing Services due to circumstances beyond our control, like severe weather or government action.
- Damage caused by not following our reasonable instructions.
We’re not responsible for any loss or damage caused by your use of our Services or equipment, or for loss of business, contracts, profits, or data.
This doesn't limit our responsibility for issues resulting from our negligence, fraud, or other unavoidable legal obligations.
How Disputes Are Resolved
If you have complaints or need assistance with disputes, check out our ‘Digiesim Code of Practice on Complaint Handling and Dispute Resolution’ available in our help centre. For alternative dispute resolution, you can reach out to Ombudsman Services at www.ombudsman-services.org.
These terms are governed by English law, and any disputes will be resolved in English courts.
Other Terms
If we don’t exercise a right under this contract, it doesn’t mean we've waived it. If any part of this contract is found to be invalid, the rest will still remain in effect.
We may transfer our rights under this contract to a third party with prior notice. Your rights under this contract are personal to you, and you cannot transfer them without our agreement.
